1. Acceptance of Terms
By accessing or using ToyTale.art ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and ToyTale.art.
2. Description of Service
ToyTale.art is a children's storytelling platform that allows children ages 6-12, under parental supervision, to:
- Upload photos of their physical toys to create digital characters
- Generate AI-powered, age-appropriate stories featuring their toy characters
- Create animations of their story characters
- Listen to AI-generated voice narration of their stories
The Service uses artificial intelligence technologies to generate content. While we strive for quality and safety, AI-generated content may occasionally contain unexpected results. All content is moderated for age-appropriateness.
3. User Accounts and Age Requirements
Parent/Guardian Accounts: You must be at least 18 years of age to create a parent account on ToyTale.art. Parent accounts are required to manage child profiles and provide verifiable parental consent under COPPA.
Child Profiles: Children ages 6-12 may use ToyTale.art only through child profiles created by a parent or legal guardian who has provided verifiable COPPA consent. Children do not create their own accounts.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Content Ownership
Your Content: You retain ownership of all photos and content you upload to ToyTale.art. By uploading content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (e.g., generating character images and stories).
Generated Content: Stories, character images, and animations generated by our AI are provided to you for personal, non-commercial use. You may save, share, and enjoy this content with family and friends.
Our Content: The ToyTale.art platform, including its design, code, and branding, remains our intellectual property and is protected by applicable copyright and trademark laws.
5. Prohibited Uses
You agree not to use the Service to:
- Upload content that is inappropriate, offensive, or harmful to children
- Attempt to bypass content moderation or safety filters
- Use the Service for any commercial purpose without our written consent
- Reverse engineer, decompile, or disassemble any part of the Service
- Interfere with or disrupt the Service or its servers
- Create accounts using false or misleading information
- Allow children to use the Service without proper parental consent
- Violate any applicable laws or regulations
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOYTALE.ART AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
We do not guarantee that AI-generated content will be free from errors or always meet your expectations. While we implement content moderation, we cannot guarantee that all generated content will be perfectly appropriate in all contexts.
7. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and notify registered users via email.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may request deletion of your account and data.
8. Termination
We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the Parent Dashboard. Upon termination, we will delete all associated child profiles and their data in accordance with our Privacy Policy.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.
